Burnaby strata sues over concrete repair that allegedly knocked out elevator

A Burnaby strata is suing a concrete repair company for allegedly slicing through electrical conduits and knocking out the highrise’s elevator.

The Empress strata, located at 6282 Kathleen Ave. in Metrotown, hired JFR Concrete Repair and Waterproofing to repair parts of the building’s parkade where rainwater had been pooling, according to a notice of civil claim filed in B.C. Supreme Court in Vancouver this month.

On Feb. 16, 2022, however, the strata alleges JFR cut through electrical conduits embedded in a concrete slab in the parkade.

The incident caused damage to the building’s electrical system and “interrupted elevator operations,” according to the civil claim.

The incident also resulted in structural damage to the concrete slab and a loss of use of the parkade areas, the claim said.

The strata claims it suffered loss, damage, cost and expense including damage to common property, the cost of investigating the cause of damage to the electrical system, the cost of investigating structural damage and erecting shoring/supports, the costs repairs and the cost of losing the use of the parkade.

The strata is now suing JFR for unspecified general and special damages for negligence and breach of duty.

None of the allegations in the notice of civil claim have been proven in court.

JFR had not yet filed a response to the strata’s claims.
