A retired Burnaby woman is suing after allegedly being hit by a pallet jack at a Metrotown mall supermarket.
Ellen Oi Lun Chow was shopping at T&T Supermarket inside Metropolis at Metrotown on March 29, 2022 when she was struck by a pallet jack being operated by a store employee, according to a notice of civil claim filed in B.C. Supreme Court last Thursday (Jan. 4).
Chow says she "suffered and will continue to suffer physical and mental injuries" as a result of the incident, including injuries to her left ankle.
She is suing T&T and Ivanhoé Cambridge, the owner of the mall, for general and special damages, including costs for past and future health care services.
Chow claims negligence on the part of T&T,Ivanhoé Cambridge and the pallet jack operator caused or contributed to the incident.
She alleges the pallet jack operator used the machine without due care and attention and didn't establish a perimeter and safely divert pedestrians around the area where he was working.
He also failed to give adequate warning before moving the jack, according to the civil claim.
Chow claims the supermarket and Ivanhoé Cambridge are vicariously liable for the incident because they failed to ensure the store was "reasonably safe" for customers.
She alleges the companies didn't ensure the employee was properly trained to use the pallet jack and didn't properly supervise him.
T&T and Ivanhoé Cambridge have not yet filed responses to Chow's claims.
None of the allegation in her notice of civil claim have been proven in court.
