Woman sues City of Burnaby after fracturing ankle by crosswalk manhole

A woman suing the City of Burnaby claims she was injured after tripping on uneven pavement near a manhole by the crosswalk at Dawson Street and Gilmore Avenue.

A Vancouver woman is suing the City of Burnaby after fracturing her ankle on a Brentwood crosswalk two years ago, according to a lawsuit filed in B.C. Supreme Court last week.

Jane Veglia said she was walking east in a marked crosswalk on the north side of Dawson Street at the Gilmore Avenue intersection on May 11, 2022.

"As she was walking, she stepped on pavement that was broken by a sunken manhole in the middle of the crosswalk, causing her to twist her ankle and fall to the ground," states her notice of civil claim.

Veglia said she sustained "serious personal injury," including a fractured right ankle and injuries to her lower back and left knee.

Besides the physical injuries, Veglia said she also suffers from mood changes and disruptions and "anxiety when walking or hiking."

Veglia said the injuries were caused by the negligence of the city and an unnamed company identified only as XYZ Corporation.

The defendants failed to properly inspect the crosswalk, remedy the hazard and/or warn Veglia about the danger, according to her claim.

She is suing them for unspecified general and specific damages for pain and suffering, loss of earnings, housekeeping and medical care.

The allegations made in the notice of civil claim have not been proven in court.

The city has not yet filed a response to the lawsuit.
