Worker hit by crane; Burnaby employer fined for trying to prevent WorkSafeBC claim

A Burnaby construction company has been fined $2,500 for trying to convince a worker not to file a WorkSafeBC claim.

The worker, employed by Castores Builders Ltd., was hit by a crane at a commercial construction site in 2023, according to WorkSafe.

WorkSafe didn't investigate the site of the incident but "information provided to the agency" sparked an investigation to determine if Castores had violated the Workers Compensation Act by preventing or trying to prevent the worker's injury claim, according to an investigation report obtained by the Burnaby NOW.

The investigation concluded there was evidence it had, according to the report, and the company was sanctioned with a $2,500 penalty in September.

The date of the crane incident and the location of the worksite where it happened were redacted in the report along with all details about the evidence WorkSafe relied on to make its decision.

The agency told the NOW the information was withheld under the Freedom of Information and Protection of Privacy Act because the details could identify the worker.

Castores did not respond to multiple requests for comment on the fine.

As of Oct. 30, the company had not appealed the penalty or asked to have it reviewed.
